**E-Bike Test Ride Liability Waiver and Release**
I hereby agree to the following terms and conditions in consideration for being permitted by Hovsco to participate in an e-bike test ride:
1. **Assumption of Risk:** I acknowledge and understand that riding an e-bike involves certain inherent risks, including but not limited to the risk of injury, accidents, and property damage. I voluntarily assume all such risks.
2. **Release of Liability:** I hereby release, waive, and discharge Hovsco, its officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of Hovsco or otherwise.
3. **Photo/Video/Image Release:** I grant Hovsco the irrevocable and unrestricted right to use and publish photographs, videos, and images of me taken during the e-bike test ride for promotional purposes, including but not limited to social media posts and paid advertisements.
4. **Consent to Receive Communications:** By signing this waiver, I consent to receive informational and marketing communications from Hovsco via SMS and email. I understand that I may unsubscribe from these communications at any time.
5. **Minor Participants:** If the participant is a minor (under 18 years old), I certify that I am the parent or legal guardian of the minor and agree to the terms of this waiver on their behalf. I acknowledge that I am fully responsible for the minor's participation in the e-bike test ride.
- If the demo rider is under 18, this waiver must be signed by that rider's parent or guardian. The parent/guardian ensures the minor rider will wear a helmet and obey California e-bike laws, including prohibiting riders under 16 from operating a Class 3 e-bike.
- California e-bike laws prohibit riders under the age of 16 from operating a Class 3 e-bike. Hovsco strictly enforces this regulation and will only allow riders under 16 the option of demo riding a Class 2 e-bike.
6. **Full Understanding:** I have read this waiver and fully understand its terms. I understand that by signing this document, I am releasing substantial rights, including any right my heirs, assigns, or I may have to bring legal action or assert a claim against Hovsco for its negligence or actions.
This waiver shall be effective for all e-bike test rides conducted by Hovsco unless revoked in writing.
